Terms of Service

These Terms of Service are subject to change. Any updates will be reflected on this page with the revised effective date.

1. Introduction

West Branch Little River Studios ("we," "our," "us") provides professional video production services under written contracts with our clients. These Terms of Service outline the principles that govern our services, payments, revisions, creative ownership, and client responsibilities.

 

2. Scope of Services

We offer customized video production solutions, which may include:

  • Pre-production: Planning, scripting, storyboarding

  • Production: Filming, equipment usage, on-site direction

  • Post-production: Editing, sound design, graphics, final delivery

Specific project details and pricing are outlined in a signed Video Production Proposal.

 

3. Payment Terms

Clients agree to pay all fees as outlined in project contracts and invoices. Our typical structure includes:

  • A deposit upon signing

  • Final balance due upon completion

  • Applicable New York sales tax

Late payments may incur fees, and final delivery is withheld until full payment is received. Alternative payment arrangements may be made if agreed upon in writing.

 

4. Revisions

Clients are generally entitled to two rounds of revisions totaling up to five hours.

  • Additional edits: $150/hour (one-hour minimum)

  • Draft delivery dates and revision windows are specified in the Contract

Alternate revision structures may be used if mutually agreed upon before production begins.

 

5. Delivery

Final videos are delivered digitally by the agreed-upon completion date, contingent upon full payment.

 

6. Termination

Either party may terminate a project with written notice.

  • If we terminate: Deposit is refunded

  • If client terminates: Deposit is non-refundable; additional fees may apply if work has exceeded the deposit

  • Final project value will be determined by our team

 

7. Ownership & Rights

Unless otherwise agreed in writing:

  • We retain ownership of raw footage and original assets

  • Clients receive rights to the final edited video for personal or business use

  • We may include branding and reserve the right to showcase work for promotional purposes

 

8. Client Responsibilities

To ensure smooth collaboration, clients agree to:

  • Provide timely feedback and approvals

  • Secure permissions for third-party content (music, talent, location, etc.)

  • Adhere to project timelines

 

9. Confidentiality & Content Use

Client content and creative assets are handled with strict confidentiality.

  • We never share or publish work without express written consent

  • Any featured work on our website or social platforms is used only with prior authorization

 

10. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages, including delays, technical issues, or content usage.

  • Liability is limited to the amount paid for services

  • We follow a 3-2-1 data protection strategy but are not responsible for any data loss

  • Clients must secure rights to any submitted third-party materials

  • We are not liable for copyright issues related to client-provided content

  • Delays in client feedback or materials may impact production timelines

 

11. Contract Validity

Proposals are valid for 30 days from the date issued. After expiration, terms and pricing may require renegotiation.
All amendments must be in writing and signed by both parties.

 

12. Data Practices

We retain necessary client information solely for project management and internal record keeping.

 

13. Governing Law

These Terms are governed by the laws of the State of New York.
